RSAC 2026: AI Governance Needs Proof

AI governance has become one of those phrases that can sound impressive while meaning almost nothing. A policy exists. A committee meets. A board slide says the organization is taking responsible AI seriously. Everyone nods. Somewhere else in the company, an AI workflow is reading production data through a service account nobody reviewed.

That gap between governance language and operational control was one of the sharper lessons around RSA Conference 2026. According to CSO Online’s RSA 2026 recap, EC-Council CEO Jay Bavisi cited a split between AI disclosure and AI governance: 84% of Fortune 500 companies referencing AI implementation in 10-K filings, while only 18% claimed to have actual AI governance mechanisms in place. Treat that as a speaker-cited conference claim, not a universal benchmark. It still captures the practical problem cleanly: AI adoption is outrunning proof.

Governance is not the intention to behave responsibly. Governance is the ability to show what systems exist, what data they touch, who or what can access that data, which controls apply, and what happened when something went wrong.

The Governance Gap Is Not a Paperwork Problem

Organizations often treat AI governance as a documentation exercise. They create policy language, approval forms, risk categories, model inventories, and acceptable-use statements. Those are useful. They are also insufficient if they are not connected to technical evidence.

An approved AI tool can still be risky if it is used with raw sensitive data. A sanctioned agent can still be dangerous if its service account is overprivileged. A documented model can still create exposure if prompts, logs, embeddings, or retrieval outputs contain regulated information. A board-approved AI program can still fail if the security team cannot show which databases approved workflows can actually access.

The distinction is simple. Approved AI means someone said yes. Governed AI means the organization can prove the yes stayed inside defined boundaries.

Regulation Is Fragmenting, but the Evidence Need Is Converging

The regulatory picture is not getting simpler. CSO’s recap reports Bavisi citing 72 countries with AI regulations or frameworks. The exact number should stay attributed to that RSA discussion, but the broader trend is easy to support: the IAPP Global AI Law and Policy Tracker shows AI legislation and policy activity spreading across jurisdictions, with no single global model for how governments are approaching AI oversight.

The European Union’s AI Act makes the issue more concrete by using a risk-based framework for AI developers and deployers. The details will vary by jurisdiction and use case, but the operational burden points in the same direction: organizations need evidence about risk, data, access, controls, monitoring, and accountability.

The NIST AI RMF Generative AI Profile is useful because it frames generative AI risk management across design, development, use, and evaluation. That lifecycle view matters. Governance cannot start at procurement and end at launch. It has to follow the data through development, deployment, monitoring, and review.

Boards Are Asking the Wrong Question

A board asking “Do we have an AI policy?” is asking a necessary question, but not a sufficient one. The better question is: “Can we prove where AI touches sensitive data?”

That question cuts through the theater. It forces the organization to answer whether AI workflows are inventoried, whether sensitive data is classified, whether service accounts are reviewed, whether access is monitored, whether prompts and outputs are governed, whether masking is used where raw data is unnecessary, and whether audit trails can reconstruct events.

It also reveals ownership gaps. AI governance rarely belongs to one team. Security, legal, privacy, compliance, data engineering, procurement, application teams, and business units all hold pieces of the puzzle. When nobody owns the data evidence, governance becomes a meeting series instead of a control model.

The License to Operate Will Depend on Data Controls

AI programs will increasingly need a defensible license to operate inside the enterprise. That license will not come from enthusiasm, executive pressure, or a vendor’s reassurance that the system is safe. It will come from controls that make AI use observable and governable.

That means knowing which data sources are connected to AI systems. It means classifying sensitive records before they enter retrieval, training, fine-tuning, analytics, or prompt workflows. It means controlling what non-human identities can access. It means monitoring runtime behavior instead of relying only on design intent. It means masking raw values when the workflow does not need them. It means keeping audit evidence strong enough to satisfy security investigations and compliance reviews.

Without that evidence, AI governance remains vulnerable to the oldest failure mode in security: beautiful policy, ugly reality.

What This Looks Like in Practice

A company approves an internal AI assistant for sales teams. The board sees the policy. Legal approves the vendor. Procurement signs the agreement. The project is considered governed.

Then security asks which databases the assistant can access, whether customer identifiers are masked, whether prompts are logged, which service account performs retrieval, and whether the system can access records outside a user’s territory. Nobody has a complete answer. The tool is approved, but the data path is not governed.

That is the governance gap. Not a missing slide. A missing chain of evidence.
